These Terms and Conditions (“Terms”) govern your use of services provided by Phenomenal Auto Care (“Company,” “we,” “us,” or “our”), including our website, Mobile Detail AI, services, software platforms, and communication systems. By using our services, including Mobile Detail AI, you agree to these Terms.
The Company provides automotive detailing services and related systems for managing bookings, customers, communications, and AI-powered tools such as Mobile Detail AI. Services and features, including Mobile Detail AI, may be modified, suspended, or discontinued at any time without notice.
By providing your contact information, including your phone number, you consent to receive communications from the Company, including SMS messages, phone calls, and emails, which may be sent using automated technology or third-party providers such as Twilio. These messages may include appointment confirmations, reminders, service updates, follow-ups, promotional messages, and communications related to Mobile Detail AI.
The form includes a required checkbox that states:
“By providing your phone number, you agree to receive SMS messages from Mobile Detail AI regarding our CRM platform and detailing marketplace. Message frequency may vary. Msg & data rates may apply. Reply STOP to opt out or HELP for help. View our Privacy Policy and Terms & Conditions.”
The checkbox is not pre-checked, and users must actively select it before submitting the form. No SMS messages are sent without explicit user consent.
In some cases, users may also provide consent verbally during a phone call initiated by the user or after the user has requested more information. During such calls, the user is read the following disclosure:
“By providing your phone number, you agree to receive SMS messages from Mobile Detail AI regarding our CRM platform and detailing marketplace. Message frequency may vary. Msg & data rates may apply. Reply STOP to opt out or HELP for help.”
Verbal consent is recorded and logged, including timestamp, phone number, and confirmation of consent. No messages are sent without documented proof of consent.
Users may opt out at any time by replying STOP to any message. For help, reply HELP. After opting out, users may receive a final confirmation message.
You agree to provide accurate information and are responsible for maintaining and updating your contact details for proper service delivery, including use of Mobile Detail AI features.
Payments must be made as agreed at the time of service. The Company reserves the right to refuse or cancel services at its discretion, including services scheduled or managed through Mobile Detail AI.
Services, including Mobile Detail AI, are provided “as is” without warranties of any kind, express or implied. The Company is not liable for any indirect, incidental, or consequential damages arising from the use of services or reliance on AI-generated outputs.
You acknowledge that Mobile Detail AI may generate automated suggestions, responses, or service-related information, and you agree not to rely solely on such outputs without independent verification where appropriate.
You agree to indemnify and hold harmless the Company from any claims arising from your use of the services, including Mobile Detail AI, or violation of these Terms.
We may use third-party providers, including CRM systems, payment processors, AI systems, and messaging services such as Twilio. We are not responsible for the actions, errors, or failures of these third parties.
The Company reserves the right to update these Terms at any time. Continued use of our services, including Mobile Detail AI, constitutes acceptance of any changes.
These Terms are governed by the laws of the State of Arizona.
